1. Acceptance of Terms
By accessing or using Afro Fanz (the “Website”), you agree to these Terms and Conditions (“Terms”), including all policies, guidelines, and any supplementary agreements referenced herein. Your continued use of the Website constitutes your acceptance of any future modifications.

2. Eligibility and Account Registration
• You must be at least 18 years old (or the legal age in your jurisdiction) to register and use the Website.
• When you register, you must provide true, current, and complete information and keep it updated.
• You are responsible for safeguarding your account credentials and for all activities under your account.

3. User-Uploaded Content and Pre-Screening Process 🕵️‍♂️
• Pre-Screening Requirement: All content uploaded or generated by users—including text, images, videos, and live streams—will be subject to a pre-screening review before publication. This process ensures that the content is lawful and does not violate the Afro Fanz Content Standards.
• Content Removal: Afro Fanz reserves the right to remove or refuse any content deemed illegal or in violation of our Standards without notice. Such removal may lead to the suspension or termination of the associated account.

4. Content Provider Agreement and Electronic Consent ✍️
For any third-party user (“Content Provider”) who uploads or generates content, including real-time/live streaming:
• Written/Electronic Agreement: Content Providers must enter into a content provider agreement with Afro Fanz. This agreement, which may be incorporated electronically into these Terms or provided via a separate document, must be affirmed through an electronic signature mechanism (for example, a checkbox stating “I agree to the T&C” or “I agree to the Model Agreement”).
• Mandatory Provisions of the Agreement:
◦ Illegal Activities: The agreement prohibits any activity that is illegal or that violates Afro Fanz Standards.
◦ Consent Requirements: Content Providers must obtain and maintain documented consent from all persons depicted in the content, including:
– Consent to be depicted;
– Consent for public distribution and uploading on Afro Fanz;
– Consent for the content to be downloaded (if applicable).
◦ Identity and Age Verification: Content Providers are required to verify, in writing, the identity and age of all persons depicted—ensuring they are legal adults—and maintain supporting documentation upon request.

5. Creator Image and Likeness Consent 📸
• Models/Creators are required to grant Afro Fanz separate, explicit consent to use and display their images/likeness.
• At the time of signup, creators must check a distinct box (separate from the general Terms acceptance) that reads, for example:
☐ “I acknowledge and agree that my images will be used and displayed publicly on the website.”
• Uploading content without providing this separate consent is not permitted.

6. Payment, Subscription, and Cancellation Policy 💳
• Afro Fanz operates on a subscription-based model, with payments processed through reputable payment processors including CCBills.
• Afro Fanz retains 22% of all earnings, which is deducted at the time of cashout/withdrawal.
• Payouts are processed on the same day that a cashout request is initiated, subject to necessary verification and compliance requirements.
• Please note that several third-party payment processors are used; these may charge additional fees during deposits or cashouts. All such fees, charges, and payment details will be handled according to the processors’ terms, and any changes will be communicated in advance.
• Refunds and billing disputes are subject to our Refund Policy, which is incorporated herein by reference.
• Cancellation Policy for Recurring Subscriptions: If you would like to cancel your subscription from rebilling, please contact our Support team at [email protected] or reach out to CCBill's Consumer Support at https://support.ccbill.com/. Cancellation of recurring subscriptions will prevent any future billing cycles; however, any outstanding or accrued charges remain your responsibility.

7. Intellectual Property Rights and License
• Users retain ownership of their original content. By submitting content, you grant Afro Fanz a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute the content in connection with the Website and its services.
• You affirm that you have obtained all necessary rights, consents, and permissions to submit such content.

8. Prohibited Activities
• Users must not engage in any illegal activities or actions that infringe upon the rights of others.
• Prohibited content includes any material that is defamatory, abusive, or that violates any applicable law or Afro Fanz Standards.
• Afro Fanz reserves the right to terminate accounts found to be in breach of this section.

9. Termination and Suspension
• Afro Fanz may suspend or terminate user accounts at any time, with or without notice, for violations of these Terms or applicable law.
• Upon termination, your access to Afro Fanz will be revoked, and Afro Fanz may retain necessary information to comply with its legal obligations.

10. Disclaimers and Limitations of Liability ⚠️
• The Website is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied.
• Afro Fanz shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Website.
• This exclusion applies to all claims, including those based on contractual or tort law.

11. Indemnification
You agree to indemnify and hold harmless Afro Fanz, its officers, directors, employees, and agents from any claim, liability, loss, or expense (including reasonable attorney fees) arising out of or in connection with your breach of these Terms.

12. Modifications to Terms
• Afro Fanz reserves the right to amend these Terms at any time.
• Revised Terms will be posted on the Website and become effective immediately upon posting. Continued use of the Website after any changes constitutes acceptance of the updated Terms.

13. Governing Law and Dispute Resolution 🇺🇸
• These Terms are governed by the laws of the United States.
• Any disputes arising under these Terms will be resolved in the appropriate courts within the United States.

14. Complaints and Content Removal Policy
• Users are permitted to report content that they believe is illegal or otherwise violates the Afro Fanz Content Standards.
• All reported complaints will be reviewed and resolved within 7 business days.
• The review process includes an initial evaluation of the reported content, followed by an investigation if necessary. You will be notified of the outcome, and you may appeal any decision made during the review process.
• Potential outcomes of any investigation may include content removal, account suspension, or other actions deemed necessary to maintain compliance with our guidelines.
